A clear overview of how The Heavens collects, uses, and protects your information.

1. Introduction
InnoDiligent LLC publishes The Heavens ("Application" or "Service"). This Privacy Policy explains how we collect, use, disclose, and protect your information when you use our Application across supported platforms (iOS, iPadOS, macOS, watchOS, tvOS, and visionOS), in accordance with applicable laws including the Virginia Consumer Data Protection Act (VCDPA).
2. Information We Collect
We collect information to provide and improve our weather services:
- Location Information: With your permission, we collect precise or approximate location data from your device to provide hyper-local weather forecasts, radar imagery, and severe weather alerts.
- Health and Fitness Data (Optional): If you grant permission, the Application may access certain health and activity metrics (such as workouts, daylight exposure, or physiological characteristics) through Apple HealthKit to calculate personalized weather and heat insights. When you turn on health personalization in Settings, a short summary — such as how much of a sunburn dose you've had today — is sent to the cloud with your forecast so the advice accounts for it.
- Account and Device Identifiers: When you use the Application, we may collect anonymous user identifiers, account credentials (if you sign in), device identifiers, and push notification tokens to deliver alerts and manage active sessions.
- User Content: We collect content you provide, such as saved locations, personal preferences, search queries, notes, and weather observations you choose to submit.
- Purchase Information: If you purchase a subscription, transactions are processed securely through Apple In-App Purchases. We receive purchase validation receipts to manage your access tier; we do not collect or store your payment card details.
- Technical and Usage Data: We collect diagnostic, performance, and usage data (such as app launches, feature interactions, and crash reports) to maintain app reliability. You may opt out of anonymous usage sharing in Settings.
3. How We Use Your Information
We use the information we collect for legitimate business and operational purposes, including:
- Delivering weather forecasts, radar, and atmospheric conditions.
- Sending critical severe-weather warnings and user-configured alerts.
- Generating personalized weather insights based on your selected preferences.
- Synchronizing your saved places, settings, and logs across your devices.
- Managing subscriptions and customer support requests.
- Protecting our services against abuse, fraud, and security risks.
- Maintaining and improving application stability and performance.
4. Information Sharing and Disclosure
We do not sell your personal data. We do not share your personal data with third parties for cross-context behavioral advertising or marketing.
We may share information with trusted third-party service providers solely to the extent necessary for them to provide operational services to us, including:
- Cloud and Infrastructure Providers: Hosting our backend services, securely storing data, and powering automated weather synthesis.
- Platform Providers (Apple): Delivering weather data, processing push notifications, managing app purchases, and syncing user data.
- Meteorological and Environmental Providers: Supplying weather models, radar imagery, air quality, pollen, and storm tracking data.
- Subscription Management: Validating subscription purchases and user entitlements.
All third-party service providers are contractually required to maintain the confidentiality and security of user data and are prohibited from using personal information for any other purpose.
Legal Requirements: We may disclose your information if required to do so by law, regulation, subpoena, or legal process.
5. Apple HealthKit Protections
In compliance with Apple App Store Review Guidelines:
- We do not use, share, or sell HealthKit data or health-derived metrics for advertising, marketing, or other use-based data mining.
- We read Apple Health only with your permission, and only ever read it — we never write to Health. When you turn on health personalization in Settings, a short summary — such as how much of a sunburn dose you've had today — is sent to the cloud with your forecast so the advice accounts for it.
6. Data Retention and Deletion
We retain personal information for as long as your account remains active or as needed to provide you with the Service. Temporary forecast and radar caches expire automatically.
Account Deletion: You can delete your account and associated personal data at any time directly within the Application by navigating to Settings → Delete Account. Deleting your account permanently removes your cloud data, saved locations, preferences, and identifiers from our systems and clears local data on your device.
7. Your Choices and Virginia Privacy Rights
You have choices and controls regarding your information:
- Permissions: You can adjust or revoke location permissions, Apple HealthKit access, or push notifications at any time through your device's operating system settings.
- Data Export: You can export your stored data directly within the Application.
Virginia Consumer Privacy Rights
If you are a Virginia resident, the Virginia Consumer Data Protection Act (VCDPA) provides you with the following rights regarding your personal data:
- Access: The right to confirm whether we process your personal data and to access such data.
- Correction: The right to correct inaccuracies in your personal data.
- Deletion: The right to delete personal data provided by or obtained about you.
- Data Portability: The right to obtain a copy of your personal data in a portable and readily usable format.
- Opt-Out: The right to opt out of targeted advertising, the sale of personal data, or profiling. (We do not sell personal data or engage in targeted advertising).
Exercising Your Rights & Appeals
To exercise your rights, email info@innodiligent.com or use the in-app controls (such as Settings → Delete Account). We will respond to authenticated requests within 45 days. If a request is denied, you may submit an appeal by contacting us at the same email address; we will respond to your appeal within 60 days with a written explanation of our decision.
8. Children’s Privacy
The Application is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13 in compliance with the Children's Online Privacy Protection Act (COPPA). If we become aware that we have inadvertently collected information from a child under 13, we will promptly delete it.
9. Data Security
We implement reasonable administrative, technical, and physical safeguards—including encryption in transit (TLS) and encryption at rest—designed to protect your personal information against unauthorized access, loss, or misuse.
10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When changes are made, we will update the "Effective Date" and "Version" at the top of this document and provide notice as appropriate.
